Société du musée d'archéologie et d'histoire de Montréal, Pointe-à-Callière (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use Pointe-à-Callière mobile application (the “Application”). Please read this Privacy Policy carefully.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

INFORMATION WE COLLECT

PERSONAL AND SENSITIVE DATA
We do not collect any sensitive and personally identifiable information such as name, email and address.

INFORMATION AUTOMATICALLY COLLECTED
We automatically collect certain information when you visit, use or navigate the Application. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your device ID, IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Application and other technical information. This information is primarily needed to maintain the security and operation of our Application, and for our internal analytics and reporting purposes.

DEVICE LOCATION
The Application use precise location to guide the user through the museum. The Application collects location data to determine user’s position in the museum even when the Application is not in use. If you wish to change our access or permissions, you may do so in your device’s settings.

MOBILE DEVICE ACCESS
We may request access or permission to certain features from your mobile device, including your mobile device’s [Bluetooth, camera, microphone, sensors, social media accounts, storage,] and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

THIRD PARTY SERVICES

USAGE OF LOCATION DATA

The Application collects location data to determine user’s position in the museum even when the Application is not in use. We do not download, store or share this data other than to determine the user’s position in the museum.

USE OF YOUR OTHER INFORMATION

The Application uses the collected data for various purposes:

• To provide and maintain the Application.
• Monitor and analyze usage and trends to improve your experience with the Application.
• To detect, prevent and address technical issues.

DISCLOSURE OF YOUR INFORMATION

We do not collect and disclose any sensitive and personally identifiable information. We only share and disclose your information in the following situations:

COMPLIANCE WITH LAWS
We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

VITAL INTERESTS AND LEGAL RIGHTS
We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
LOG DATA

We want to inform you that whenever you use our Service, in a case of an error in the Application we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the Application when utilizing our Service, the time and date of your use of the Service, and other statistics.

TRACKING TECHNOLOGIES

COOKIES AND WEB BEACONS
We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Application to help customize the Application and improve your experience. When you access the Application, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Application. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

APPLICATION ANALYTICS
We may also partner with selected third-party vendors, such as Google Analytics and Firebase Analytics to allow tracking technologies and remarketing services on the Application through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Application, determine the popularity of certain content, and better understand online activity. By accessing the Application, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors.

THIRD-PARTY WEBSITES

The Application may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Application, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practises and policies of any third parties, including other sites, services or applications that may be linked to or from the Application.

SECURITY OF DATA

The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

CHILDREN'S PRIVACY

The Application is specifically created for an adult audience and doesn’t aim children under 13. We do not knowingly collect personally identifiable information from anyone under the age of 13.
If you are a parent or guardian and you are aware that your Children have provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our databases.

SPECIFIC PRIVACY RIGHTS FOR CALIFORNIA RESIDENTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
